Railways told to pay for mental trauma caused to passengers

The district consumer dispute redressal forum in Mandsaur has asked Indian Railways to pay cost of ticket, taxi fare, compensation for mental trauma and cost of litigation to two families, who were denied seats in Jabalpur-Veraval express train despite having reservations.Though the complainants filed the complaint with the consumer forum way back in 2009, the order came only on Wednesday. The family had booked six tickets from Ratlam to Veraval in Jabalpur-Veraval express on December 23, 2008."I boarded the train from Ratlam with my family, including two children. Our seats were occupied and we were forced to stand. We had lodged first complaint with the station master at Ahmedabad, but to no avail. We then had to break the journey at Rajkot and hire a taxi to Veraval," said Sandeep Bhargav, one of the complainant.The aggrieved family from Mandsaur, moved a complaint in the consumer forum against station managers of Ratlam and Mandsaur in Madhya Pradesh and Ahmedabad and Viramgam in Gujarat.Railway officials denied the charges and contented that the passengers did not take the seats which were allotted to them and instead they boarded a different coach.However, the forum overruled the railway's contention stating that the passengers were forced to stand in train and take a taxi to their destination in spite of reservations, causing an undue harassment.The court has ordered the railways to pay Rs 13,000 to the family, including Rs 3,000 they paid for the taxi from Rajkot to Veraval, Rs 1,500 each to six members as compensation for mental trauma and Rs 1,000 as cost of litigation.
