Texas sheriff’s deputy is arrested for domestic violence for the second time this year after 'kicking his girlfriend in the face and then forcibly stripping her blooded clothing to destroy evidence'

A Texas deputy has been arrested for a second time in 10 months after allegedly attacking his partner and kicking her in the face in a 'carbon copy' of the previous assault, police said. 

Bexar County Sheriff's Deputy John Paul Garza, 31, of San Antonio, Texas, was arrested early Monday morning and charged with continuous violence against family and violation of a protective order, My San Antonio reported. 

Bexar County Sheriff Javier Salazar said Monday that deputies had been called a home in San Antonio on Sunday night, after a woman told police that Garza had knocked her to the ground and kicked her in the face. 

She claimed that during the incident, her clothes had gotten bloody and that Garza had forcibly removed the from her body in an attempt to destroy the evidence, the sheriff said. 

The woman, in her underwear, was said to have run to a neighbor's house to get help, while Garza allegedly fled the scene.

Police arrested Garza - an eight-year veteran of the force and current patrol deputy - several hours later. 

Salazar said that the alleged assault read like a 'carbon copy' of the previous assault Garza had been accused of in February - against the same woman, who had been reported to be either Garza's girlfriend or his wife. 

The difference, Salazar said, was that the second assault was more violent.  

The Sheriff said that it appeared that the couple were in the process of reconciling when the second alleged assault occurred.  

That initial alleged assault had resulted in Garza being put on unpaid administrative leave for the last 10 months. Garza was given a termination notice earlier this month but is in the process of appealing it.

Salazar said in a statement that he 'would love to be able to terminate people on the spot for issues like this, the fact is that there is due process that has to occur.'

The Sheriff noted that the internal affairs process is slow and reliant on criminal proceedings before decisions can be made.

However, Salazar said, Garza will receive a second termination dismissal as a result of this latest incident. 

In 2013, Garza was placed on a 10-day suspension after he was said to have used inappropriate force on an inmate. 

During that incident, the inmate was said to have retaliated and assaulted Garza, who then lied about what happened while taking a polygraph test. 

Garza's bail was set at $20,000.
