Grandparents of three children who died in a horrific fire called for the woman who left them to be more harshly 'punished' after she was sentenced to just six months probation for leaving them at the home.

Amber Swain was given the sentence for misdemeanor child abuse after she left three kids under the age of 10 alone when the family's Eastpointe, Michigan, home burned down. 

'This was a mistake, a horrific mistake, with terrible consequences,' said attorney John Dakmak

At around 4am one morning in March 2018, Swain left the children at the home as she went to go pick up her sister from work. Swain's two sons, nine-year-old Brendan Mahone and his eight-year-old brother Zyahir Swain, and her niece four-year-old Madison Swain were at the home when it caught fire. 

All three died from smoke inhalation.

'There isn't a day that goes by that she doesn't think of her kid,' Dakmak said. 'Probably every minute that goes by.' 

Dakmak described the freak incident as an accident.  

'An accidental fire, maybe a wiring issue, a spark arced between wires and caught the basement on fire,' Dakmak said. 'It smoldered and then it engulfed them.'

But the grandparents of the boys feel that they could have been called to watch the children, as they lived right down the street.

'The bikes are still in the garage, their clothes are here, their TV, their games, they practically lived here,' said Brenda Mosley, the boy's grandmother.

Dennis Mosley, their grandfather, said of the boy's mother: 'You should be punished for what you did.'

While the couple weren't fans of the sentence, they have forgiven the woman for the incident. 

'I don't like what went on but what can I do,' Brenda said. 'But one thing I have is good memories of them.' 

Dakmak asserted that his client was punished every day but still needed to take care of her other two children.   

'She still has two youngsters to care for and I think that had a lot to with when we got to today,' the attorney added. 

The lawyer shared that Amber's sister has stood by her for the past two years, even with losing her only child.
