Cuomo impeachment committee is investigating the nursing home scandal, if he used state resources to write his book, if he got his family early access to COVID tests AND sexual harassment claims - and will share evidence 'as early as this month'

The impeachment committee investigating Governor Cuomo isn't just looking at the sexual harassment claims against him but also the nursing home scandal, whether or not he used state resources to write his pandemic book and whether or not he got his family early access to COVID tests. 

The committee's held a hearing on Monday to discuss its ongoing investigation into whether or not to launch impeachment proceedings. 

Its investigation is not yet complete but once it is, the committee says it will share all of the evidence it finds and discuss it 'openly'. 

That could happen as early as this month, Chair Charles D. Lavine said at Monday's meeting. 

More sessions have been scheduled for August 16 and August 23.

Committee members will have to examine hundreds of thousands of pages of documents, including 500,000 pages of evidence relating to the nursing home scandal. 

After August 23, the committee will hold public hearings where they will hear from sexual harassment experts. 

Then, the committee will make a recommendation to the entire 150-member Assembly on whether or not to impeach. 

'We anticipate this process will be concluded very soon,' Committee Chair Charles D. Lavine said, adding it will take 'weeks'.

Lavine said Cuomo would have the opportunity to 'address' all of the issues. 

'We commend the Attorney General on her work and her agreement to provide relevant materials to this committee. 

'The findings and the content of this report are deeply disturbing. 

'We will review that report in detail and consider it together with this committee's own independent investigation.

'The Governor's attorneys have criticized that report and their access to underlying information. Those issues should be directed to the Attorney General,' Lavine said.

The 20-member committee started investigating Cuomo and whether or not to impeach him in March 2021, when the Attorney General launched her investigation into the sexual harassment claims.

They were tasked with not only looking at the sex harassment claims but also Cuomo's administration's counting of COVID-19 deaths among nursing home residents. 

He had been counting them as hospital deaths because the patients contracted the virus in nursing homes but later died in hospitals, rather than dying in hospitals.

Critics said it was more than just a coincidence, given Cuomo had issued a directive which ordered nursing homes to accept COVID-19 patients to try to keep hospital beds free. 

Some said it was his way of trying to fluff numbers and make it seem like fewer had died than was the case.

The committee is also looking into whether or not he used any state resources - staff or money - to write his profit-making book, Lessons in Leadership.

Cuomo was given millions for the book and he gave his three daughters $300,000 each from the advance. 

The book was considered distasteful by many, given the fact the pandemic remains ongoing and at the time, vaccines weren't even available yet.

The final element of the impeachment committee's investigation is whether or not Cuomo got his family early or preferential access to COVID-19 tests when there was a shortage. 

The committee hasn't said when its investigation will be complete, but Cuomo's attorneys have until August 13 to submit their own evidence for consideration. 

If the committee decides to launch impeachment proceedings, the next step would be a vote in the Assembly, where there are 150 members. 

A majority of 76 is needed to advance the proceedings to a trial and 86 have already said they'd vote to impeach. 

Then, the vote would go to a High Court of Impeachment which would consist of all of the state's sitting senators and seven judges from the Court of Appeals.

Only one other New York Governor has been impeached before - Gov. William Sulzer in 1913.
