Jury in the trial of Sydney swim coach accused of nine counts of sex with a child under 10 is sensationally DISCHARGED

The jury in the high-profile sex abuse case involving a young swim coach and a number of young children has been discharged on the second day of the trial.

Kyle James Henk Daniels, 22, was due to face day two of his five week trial in Downing Centre District Court on Tuesday after pleading not guilty to 26 charges, including nine counts of having sexual intercourse with a child under 10. 

But on Tuesday morning, Judge Kara Shead discharged the jury and ordered a restart on Wednesday.

'Something has occurred overnight that was unexpected and as a result of that I am discharging you as the jury,' Judge Shead told the court.

Daniels was supported in court by his parents Janine and James as he was told of the delay to his trial.

On Monday, the first day of the trial, the court had heard how one of his alleged victims had written a note to her mother after one lesson, claiming Daniels 'touched' her. 

'The reason I didn't like my swimming lesson was because my teacher touched my ,' the full note read. 

That note came after another parent contacted pool management to notify them of a complaint from her daughter that Daniels had touched her chest and upper legs.

Daniels' next class was observed without telling him why.

His superiors noted a 'hands on' approach and that his coaching style was too close contact, and that he appeared 'overly energetic' and 'too friendly with children in his class'.

Daniels is alleged to have sexually assaulted nine young girls he was teaching at Mosman Swim Centre between 2018 and 2019

A memo was sent to all staff instructing teachers not to hold children close to the groin and chest area, and to always have their hands above water and appropriately positioned on the body. 

A police investigation was launched and Daniels' was arrested in March 2019. After the case was publicised, six more girls came forward and raised similar incidents. 

There had already been several push backs to the start of Daniels' marathon trial as his legal team and Crown Prosecutors debated how best to gather the evidence of his alleged victims.

Because of their age, some of the alleged victims have given pre-recorded evidence.

Some of the alleged victims were supported by family members during the interview or were allowed to hold onto toys or colouring books.

A former student at the elite Knox Grammar School, Daniels was a University of Sydney student at the time he was charged 

The former prefect at elite Sydney school Knox Grammar is alleged to have assaulted his young students at the Mosman Swim Centre between June 2018 and March 2019.

Daniels remains on $100,000 bail with strict conditions banning him swimming pools, beaches, video arcades, schools and playgrounds.

He is also restricted from any water sports where a child under 16 may be present.

A new jury will be impanelled in Downing Centre District Court on Wednesday morning.
