Drink-driving e-scooter rider, 53, is banned from road for three years after he was caught on A38 while over legal limit

An 53-year-old e-scooter rider was caught drink-driving on the A38, a court heard.

Kevin Elliott was banned from driving for three years after he was caught over the legal alcohol limit.

Magistrates are having to deal with more illegal e-scooter drivers as their popularity soars - but the same laws apply as driving a car.

Elliott, from Leigham, pleaded guilty to riding a Mi e-scooter on the A38 in Plymouth while above the legal alcohol limit for driving on June 1.

He had 57 micrograms of alcohol in 100 millilitres of breath, above the legal limit of 35 micrograms.

Elliott also admitted possession of the Class B drug cannabis on that day.

Magistrates handed him a three-week electronically-monitored curfew earlier this month.

He is confined to his house and garden from 9pm to 7am each night until August 31.

Elliott was also disqualified from driving all vehicles for three years and ordered to pay £95 victim surcharge and £85 costs.

The prosecution comes as more people take to e-scooters, with some hailing them as the answer to many traffic problems in cities.

Some areas such as London and Oxford are running pilot schemes, with scooters in ranks on the street for people to use.

But police in Plymouth warned in May the laws of the road apply outside of those areas - and riders faced arrest.

Last month e-scooter rider Tommy Holden was banned from the road for going through a no entry sign and damaging a car.

The uninsured and unlicensed 22-year-old from Efford damaged the windscreen of a VW Touran in Stonehouse.

In June, Daniel Coles was banned from the road after he was stopped on an e-scooter while three times the drink-drive limit.

Coles, 26, from Stoke, pleaded guilty to driving a motor vehicle while over the legal alcohol limit in Millbay on June 18.

In May, another man also appeared at Plymouth Magistrates' Court to admit driving while disqualified and driving without insurance.

Joshua Bishop was disqualified for a further 13 months. He was understood to have been the first person in Devon and Cornwall to appear in court on e-scooter charges.
