Judge rules Sharks' Evander Kane can be deposed and must hand over evidence in lawsuit that he 'promised to pay woman $3 million to abort his child'
A federal bankruptcy judge has ruled that San Jose Sharks winger Evander Kane must face discovery in a lawsuit filed by a woman who claims he reneged on a promise to pay her as much as $3 million if she aborted their unborn child.
Hope Parker, who first sued Kane in California in 2018, can now seek testimony and electronic correspondences from the 30-year-old NHL star.
Parker claims to have undergone two abortions after being impregnated by Kane, who allegedly paid her $125,000 for the second, but refused to do so a third time until he offered her 'between two million and three million dollars,' according to court filings obtained by DailyMail.com.
He then allegedly changed his mind and refused to pay, even after she shared proof of the abortion with him.
Kane filed for bankruptcy in January after amassing more than $28 million in debts, according to court filings reviewed by DailyMail.com.
In response to Kane's bankruptcy filing, Parker filed a separate case within Chapter 7 to prevent him from being able to walk away from any debts he may end up owing her. Porter's 2018 lawsuit was previously delayed by the COVID-19 pandemic last year and then stayed after Kane filed for bankruptcy in January, according to The Athletic.

Debts cannot be waived under bankruptcy law if they were obtained under false pretense.
Federal bankruptcy judge Stephen Johnson has not yet ruled in Parker's favor, instead deciding that she may proceed with discovery, which would likely include electronic communications between the two.
'Plaintiff was unwilling to terminate the third pregnancy until Defendant offered her two to three million dollars to do so,' Johnson wrote.
'Then, on June 13, 2018, Plaintiff sent Defendant a text message of her lab results, which confirmed she had terminated the third pregnancy. When Plaintiff requested Defendant update her on the status of her payment, Defendant, for the first time, told he was not going to pay her, stating: 'I'll have my lawyer contact you I'm not dealing with this any further then.'
'I can infer from the complaint that Plaintiff falsely said he would pay … to abort the third pregnancy, and that he did so to deceive into actually undergoing that abortion.'
Kane and Porter had a romantic relationship between 2016 and 2018, according to court filings.
' was aware and advised by Ms. Parker that she was not using birth control as it upset her system,' read a court filing obtained by DailyMail.com. 'During each encounter, the parties rarely, if ever used contraception.'

Most notably, he was accused by his now-estranged wife of betting against the Sharks and trying to ensure defeat by playing poorly.
'How does the NHL let a compulsive gambling addict still play when he's obviously throwing games to win money?' she asked on social media. 'Hmm maybe someone needs to address this.'

Kane has denied the allegation.
'I have NEVER gambled/bet on Hockey, NEVER gambled/bet on a Sharks game, NEVER gambled/bet on any of my games and NEVER thrown a hockey game,' he wrote on Twitter.
'The facts are I personally had my best season of the my career last year and was the most consistent I've been throughout any season, I'm proud of that. I love the game of Hockey and would never do any of what was alleged. I look forward to cooperating fully with the league's investigation, having my name cleared and looking forward to this upcoming season.'

Evander Kane responded by calling her 'mentally unwell' and saying they are in the process of getting divorced. The couple is also selling their $3.2 million home, according to Realtor.com.
In a separate post, Anna Kane accused her husband of spending lavishly partying in Europe.
He responded by saying that she prevented him from seeing their daughter.
'I love my daughter,' he wrote. 'I will and always have taken care of my daughter in every way possible. I have always made sure her mother has had everything she's needed and more. I have tried to de-escalate our divorce issues and be as civil and calm as anyone in this position could.
'I have tried to set up FaceTime calls but not every day as I would like to because of being restricted by her mom. She has refused me to see her and had unfortunately tried to use my daughter as leverage. I will continue to always take care of my family, that goes without question.'

The NHL has initiated an investigation into the gambling allegations.
'The integrity of our game is paramount and the League takes these allegations very seriously,' read a league statement.
Kane was also sued in 2019 after allegedly failing to repay a $500,000 gambling debut.
He is in the midst of a seven-year, $49 million deal with the Sharks. Kane has earned more than $62 million in salary over his 13-year NHL career.
