We're not saying that 99.9 percent of teenage boys wouldn't also love to take Ms. Upton to prom, but Davidson's attempt to jokingly woo the model is particularly endearing. While doing push-ups, he lists their many common interests, like food and Sports Illustrated (she poses in it, he reads it). Sure, it's borderline cringe-worthy, but can you blame the guy for trying?

It's hardly been two months since Ashley Judd and husband Dario Franchitti decided to pull the plug on their 10-year marriage, but the newly single actress was already turning heads on the red carpet on Monday, March 18.

The Olympus Has Fallen actress, 44, wore a low-cut, skin-tight teal Herve Leger dress that accentuated her enviable figure. Judd practically glowed as she greeted her costars -- including Morgan Freeman and a very appreciative Gerard Butler, 43.
According to an onlooker, the pair spent most of their time at the film premiere's after party -- held at Hollywood's Lure nightclub -- chatting as cameras snapped their photo together.

"Ashley smiled the whole time while talking to Gerard," the source tell Us Weekly.

Judd and Franchitti, 39, announced their decision to split in late January, telling Us in a statement that they would "always be family."

"We'll always be family and continue to cherish our relationship based on the special love, integrity, and respect we have always enjoyed," said the couple, who do not have children together.

Earlier in the evening, Judd was letting sister Wynonna Judd, 48, take the spotlight in her debut performance on the premiere of Dancing With the Stars.

At one point following Wynonna's performance, their mother Naomi frantically motioned to the TV audience to call in to vote for Wynonna, even reaching over to encourage Ashley to do the same.

Citigroup to pay $730M

Citigroup to pay $730M, Citigroup now agreed to pay all $730 million to settle a class-action lawsuit that claimed investors were misled by the bank's disclosures when they purchased its debt and preferred stock.

The purchases were made from May 11, 2006 through Nov. 28, 2008.

Citigroup denied the allegations and said in a statement late Monday that it agreed to the settlement so it could avoid further expenses and uncertainties that come along with drawn out litigation.

"This settlement is another significant step toward resolving our exposure to claims arising from the financial crisis, and we look forward to putting this matter behind us," the company said.

Citigroup said the proposed $730 million payment will be made from existing litigation reserves. The settlement will be reviewed by Judge Sidney Stein in the U.S. District Court for the Southern District of New York, where the lawsuit is pending.

Citigroup has been undergoing a transformation since Michael Corbat took over as CEO after former CEO Vikram Pandit resigned abruptly in October.

Corbat's first bold move was a decision, announced in December, to cut 11,000 jobs, close dozens of branches and trim the company's consumer banking business in some countries.

In January Citigroup announced a settlement with federal regulators related to its foreclosure practices. The bank allegedly took part in industry-wide practices that caused people to be foreclosed on illegally. It took a fourth-quarter charge of $305 million to cover its agreement with the Office of the Comptroller of the Currency and the Federal Reserve.

The plaintiffs had argued that Citigroup misrepresented its exposure to mortgage-related assets, according to Bernstein Litowitz Berger & Grossman, the plaintiffs attorneys.

Citi also understated the loss reserves for its mortgage loans and "falsely stated" that assets held off its balance sheet were of high value, Bernstein Litowitz said.

"It wasn't until November 2008, when the bank received substantial government assistance, that investors learned the full truth about Citigroup's financial condition," the law firm said.

In a statement, Citi denied the allegations, but said it was settling the case "solely to eliminate the uncertainties, burden and expense of further protracted litigation".

Citi called the settlement, which must be approved by the US district court, "another significant step toward resolving our exposure to claims arising from the financial crisis".

"We look forward to putting this matter behind us," the bank said.

The plaintiffs in the case included the Arkansas Teacher Retirement Systems and the Louisiana Sheriffs' Pension and Relief Fund.

In August 2012, Citi announced a $590m settlement with investors in Citigroup shares who had charged that the company hid its exposure to the collateralized debt obligations market in order to prop up its share price.

The investors took heavy losses after the losses became public and Citi's share price tanked.

In that case, Citi also denied the substance of the allegations and said it was settling to avoid any more legal costs.

Sinkhole swallows pond, Stuns whole nation

Mark Korb has reported that he woke up on Sunday morning and noticed that the man-made pond in his garden had completely drained away.

Korb has said, "This looks like the moon," according to NBC News.

A massive sinkhole reportedly caused the water to drain.

Korb has also described that a few years ago he manually drained the pond, and that it took him a full seven days to complete the draining.

However, the sinkhole managed to drain the entire pond just overnight.

"I would guess probably four to five hours for this whole area to drain," Korb said.

The report comes just weeks after another sinkhole appeared in Tampa, Florida, just a few miles from yet another sinkhole that devoured a man as he laid in his bed at home.

The second Florida sinkhole is not thought to pose an immediate danger to anyone, authorities reassured at the time. Hillsborough County spokesman, Willie Puz, has described that it has appeared between two homes and was about 12-feet round, 3 feet deep around the edge and about 5 feet deep in the center.

That second sinkhole was reportedly completely unrelated to the one that tragically swallowed 37-year-old Jeff Bush in his bedroom prior to that.

The first sinkhole in Florida gained international media coverage, leaving readers shocked as Bush was sucked down into a hole that suddenly opened up under his bedroom.

Bush's family members have recalled to media that they were all preparing for bed when they heard a loud crashing sound and then Jeff Bush screaming as he was sucked down into the hole.

That first sinkhole measured about 30 feet wide and 60 feet deep, and since it opened up it has become filled with clay and debris.

Officials have stated that despite a thorough search it is highly unlikely that Bush's body will ever be recovered from the hole.

The home was bulldozed to the ground, and officials will now move to stabilize the sinkhole so it does not cause any further issues to the other residents in the area.

Already two other houses nearby the sinkhole home have been evacuated through fears that they too could collapse, as the foundations below the structures have been significantly weakened.

Pentagon bans 60mm mortar round after Marine deaths

A mortar shell explosion killed seven Marines and injured seven more during mountain warfare training in Nevada's high desert, prompting the Pentagon to immediately halt the use of the weapons until an investigation can determine their safety, officials said Tuesday.

The explosion occurred Monday night at the Hawthorne Army Depot, a sprawling facility used by troops heading overseas, during an exercise involving the 2nd Marine Expeditionary Force from Camp Lejeune, N.C. Several Marines from the unit were injured in the blast, authorities said.

The Marines were practicing firing mortars, reports CBS affiliate KTVN-TV in Reno, when one of the rounds exploded while still inside the tube.

Brig. Gen. Jim Lukeman said investigators were trying to determine the cause of the malfunction.

The Pentagon expanded a temporary ban to prohibit the military from firing any 60 mm mortar rounds until the results of the investigation. The Marine Corps said Tuesday a "blanket suspension" of 60 mm mortars and associated firing tubes is in effect.

The Pentagon earlier had suspended use of all high-explosive and illumination mortar rounds that were in the same manufacturing lots as ones fired in Nevada.

Most notably, the giant pond that had once been in his yard, which was now a gaping crater in the ground. The Newcastle, Calif., man says the manmade pond on his property fell into a sinkhole that sucked it up in a matter of hours. The speed at which the underground cavity devoured the pond was staggering.

Korb noted, by contrast, for instance, that when he drained the pond years ago with a pump the process took seven days. A geology professor from nearby Sierra College attributed the sinkhole to old mining activity or a preexisting fracture rather than groundwater dissolving material.

Newborn twin deaths, The magistrate has found 26-year-old Tennessee woman guilty of murder on Tuesday in the 2011 smothering deaths of newborn twins found in her laundry basket.

The jury of seven men and five women convicted Lindsey Lowe, of suburban Nashville, of felony murder, premeditated murder and aggravated child abuse. She was immediately sentenced to life in prison by the judge.

Lowe, who was often emotional at trial, didn't break down as the sentence was pronounced. She was dry-eyed when she turned to sobbing family members and friends in the courtroom before being taken into custody.

The defendant, who toted a Bible throughout much of the seven-day trial, told them softly, "I'm OK. I love you all. He's with me," as she pointed toward the sky.

At trial, jurors saw a video of Lowe telling police she had given birth alone on Sept. 12, 2011, in the bathroom of her parents' home on a quiet cul-de-sac in an upper-middle-class neighborhood.

The bodies weren't found until two days later. A family member discovered one baby dead in a laundry basket at the home in Hendersonville, 20 miles northeast of Nashville. When police arrived to investigate, officers found the second body under a bloody sheet in the same basket.

Lowe was engaged at the time but became pregnant during an affair with another man, jurors were told. She hid the pregnancy from her family and friends, and the defense and prosecution offered competing arguments as to why.

Hendersonville Police Detective Steve Malach testified that Lowe told him during an interrogation that she had kept her pregnancy secret so as not to disappoint her fiance or add to the stress of a family member's illness. In a video of the interrogation, Lowe said she "maybe" smothered the babies.

"I was just trying to keep them quiet," she said on the video.

Two police officers who found the babies in Lowe's laundry basket were barely able to contain their emotions as they recalled the events on the witness stand.

Officer Jeremy Fentress described pulling back a bloody towel. He then had to stop speaking for a few seconds before continuing: "After I pulled the bloody towel back, I saw a deceased infant."

Fentress said he touched the baby with two fingers and found the infant was cold and not breathing.

The second was found by Sgt. James Garrett, who fought back tears as he described how the two babies were still attached by their umbilical cords to a single placenta.

Prosecutors also introduced graphic autopsy photographs of the infants.

Det. Malach testified that police searched the home thoroughly but found no evidence that Lowe had made any plans for the birth.

The defense argued that Lowe's confession was not reliable because she was "divorced from reality" at the time.

Psychiatrist Dr. William Kenner testified for the defense that Lowe had blocked out her pregnancy, then suffered shock and delirium from blood loss after she gave birth.

"Lindsey Lowe was pregnant, but she refused to accept it, her mind refused to accept it," defense attorney John Pellegrin had told the jury.

Prosecutor Ray Whitley countered that by presenting evidence of Internet searches on Lowe's iPhone for information on inducing labor.

Family, friends and church members, who have rallied to support Lowe, were sobbing after the verdict was read by Judge Dee David Gay.

The two murder convictions both carry a life sentence, which in Tennessee means Lowe will serve a mandatory 51 years in prison. Judge Dee Gay will rule on whether the two sentences will be served concurrently or consecutively at an April hearing. Gee will also determine whether Lowe must serve additional time for the aggravated child abuse conviction.

Defense attorney Pellegrin declined to comment after the verdict.

District Attorney General Ray Whitley sad it was a "sad situation for a young lady to get a life sentence, but she's the one who did it."

Lowe's father, Mark, and sister, Lacey, testified on her behalf during the trial, both saying no one knew she was pregnant. The sister said they both had been in a wedding just days before the birth and Lindsey Lowe didn't appear pregnant when she undressed in front of other women in the wedding party.

The defendant didn't testify. "I just don't feel like I can emotionally handle it," she told the judge Monday, while fighting back tears,

Newborn twin deaths, The police officer had choked up and another officer fought back tears Tuesday as they testified about finding two dead babies in a laundry basket at the home of a young Tennessee woman charged with murder.

Officer Jeremy Fentress took the stand and described entering the bedroom of defendant Lindsey Lowe and pulling back a bloody towel. He stopped speaking for a few seconds, then told the court: "After I pulled the bloody towel back, I saw a deceased infant."

Fentress said he touched the baby with two fingers and found the infant was cold and not breathing. The newborn was the first of two found Sept. 14, 2011, in a two-story home of an upper-middle-class neighborhood in Hendersonville, about 20 miles northeast of Nashville.

The second was found by Sgt. James Garrett, who described getting ready to lay the first baby down on a bed "softly and gently" before he discovered the umbilical cord, still attached to something deeper in the basket. Fentress held the body of the first baby while Garrett pulled aside a sheet to uncover the second one — also dead. Garrett said he placed the first baby back in the basket beside his brother.

Lowe, now 26, is facing two counts of first-degree murder at her trial, which opened Monday.

She had told police she gave birth to the twin boys in the bathroom of the home on the night of Sept. 12, 2011, and smothered them so that her parents would not hear their cries. Lowe's parents found one of the babies two days later and alerted police.

Assistant District Attorney General Ron Blanton recalled Lowe's statement to police as, "I just put my hand down there over their mouth — the baby's mouth — until it stopped crying."

But defense attorney John Pellegrin suggested in opening statements that Lowe didn't clearly recall what had happened that night, and the police detective who interviewed Lowe planted the idea that she had smothered the babies.

Both sides in the case agree that Lowe did not act like a pregnant woman in the days and weeks leading up to the birth.

"Officers, during their search of the house, found no evidence of an expectation of life," Assistant District Attorney Blanton said during opening statements. "There were no diapers, no pacis (pacifiers), no blankets, no car seat."

Pellegrin also told jurors Lowe was a bridesmaid in a wedding the weekend before the birth where she was dancing, laughing and posing for pictures. The night before the births, one of her sorority sisters stayed at her house, even sleeping in Lowe's bed, he said. And yet no one knew she was pregnant.

Prosecutors suggested that a lack of preparations showed Lowe never intended for the babies to live.

They pointed out that Lowe had been engaged to her college sweetheart in 2011, but had gotten pregnant when she had an affair with another man.

"Miss Lowe made no preparation for the births of these children because no one was going to interfere with her life," Blanton said in opening statements.

But defense attorneys argued that the case was not so simple.

"Lindsey Lowe was pregnant, but she refused to accept it, her mind refused to accept it," Pellegrin said. He argued that Lowe didn't realize what was happening when she started to give birth in the bathroom.

"She thinks her internal organs are coming out," he told the jury.

Family, friends and church members have come to Lowe's defense.

In earlier hearings, Lowe's father Mark Lowe described her as a "model daughter," saying she moved back in with her family after graduating from Western Kentucky University in 2008 and took care of her mother, who had a brain tumor.

The final witness Tuesday was Det. Steve Malach, who interviewed Lowe after the babies were discovered. He testified how Lowe told him she gave birth and then put the babies in a laundry basket. When he asked if she ever checked on them, "she said she couldn't face it," he told jurors.

If convicted of first-degree murder, Lowe could face life in prison without parole. Prosecutors had said previously they would not seek the death penalty.

Testimony will conintue on wednesday.

Nude beach shut down

Nude beach shut down, Wisconsin authorities on Tuesday announced they will shut down one of nation’s most popular nude beaches on weekdays after struggling for years to curtail sex and drugs on the sandbar and surrounding woods.

Nudists from around the country have been traveling to the public beach on the Wisconsin River near Mazomanie, about 25 miles northwest of Madison, for decades as word spread that prosecutors in ultra-liberal Dane County wouldn’t go after anyone for showing skin. But visitors haven’t stopped at just stripping down. They’ve been slipping off into the woods for trysts and drugs.

Authorities say that’s crossing the line, but they haven’t been able to stop the shenanigans. Their frustration reached a tipping point Tuesday, when the state Department of Natural Resources announced it will close the beach, the islands immediately off it and the surrounding woods to the public on weekdays, when wardens say troublemakers tend to operate unseen. The closures begin immediately. The area will remain open on weekends, though.

Bob Morton, executive director of the Austin, Tex.-based Naturist Action Committee, which lobbies on behalf of nudists, has visited the beach several times. He criticized the DNR for not consulting with beachgoers before closing the area.

“Honestly, we’re on their side when it comes to enforcing things that are lewd and lascivious,” Morton said. “There’s something to be said about consulting the users of the place. There’s got to be more to this somewhere.”

Nate Kroeplin, who supervises DNR law enforcement in Dane County, said wardens reviewed data on citations and determined most violations happen on weekdays, when fewer people are around to police each other’s behavior. Of the 92 citations wardens issued for disorderly conduct or drugs in the beach area between 2008 and 2012, 83 were given on weekdays, he said.

“Obviously we’re disappointed when we have to shut any portion of our property down,” he said. “But our ultimate goal is to have a safe place anybody can feel comfortable using. And with the current activity going on down there, that’s just not the case.”

The beach has been a problem for wardens for years. The DNR purchased the area in 1949 in an effort to open up more land for public hunting, fishing and recreation. Droves of nudists claimed the beach as their own, though, emboldened by local prosecutors’ indifference. Wisconsin law makes exposing one’s genitals a misdemeanor, but a long line of Dane County district attorneys have said naked people must cause some kind of disturbance before they can be prosecuted. The DNR estimates as many as 70,000 people, some from as far away as Florida, have visited the beach some summers.

With all the skin has come sex and drugs. Warden arrest reports tell graphic stories of oral sex and mutual masturbation.

The agency closed the area at night and banned beach camping in the late 1990s. Authorities also installed a gate blocking vehicles in hopes of stopping people from driving down to the beach in search of quick sex.

In 2007, wardens closed off parts of the woods around the beach to discourage sex in the underbrush and cut down brush around the beach to eliminate cover. The DNR closed another 70 acres around the beach last spring, but Kroeplin said it hasn’t stopped people from cruising the beach parking lot on weekdays, when relatively few people are around to complain.

“It’s pretty incredible to see the amount of traffic that pulls onto the property,” Kroeplin said. “Everything we’ve done has not made any difference.”

Symptoms of Bell's Palsy commence with cold-like issues, but then the side-affects get more intense. The worst of it happens in the first few days, according to PubMed Health.

Paralysis usually only occurs in half of the face but can lead to difficulty with eating.

Treatment is usually unnecessary, and the symptoms typically resolve themselves, although it can take anywhere from a week to over a month to build back muscle strength in the face and make a full recovery.

It is not clear what the exact cause of Bell's Palsy is, but it has been linked to exposure to a viral infection, according to Huffington Post.

What is Bell's Palsy?

It is a form of temporary facial paralysis which is produced as a result of damage or trauma of the facial nerves. The facial nerve is found in a narrow, bony canal (called the Fallopian canal) in the skull, beneath the ear, to the muscles on each side of the face.

In Bell's Palsy the function of the facial nerve is disrupted, and the messages sent from the brain to the facial muscles are interrupted, which results in facial weakness or paralysis.

Symptoms include twitching, weakness, or paralysis on one or rarely both sides of the face. Other symptoms may include drooping of the eyelid and corner of the mouth, drooling, dryness of the eye or mouth, impairment of taste, and excessive tearing in one eye.

What causes Bell's Palsy?

How is it diagnosed?

There is no specific laboratory test to confirm diagnosis of the disorder.

How is it treated?

Because the condition affects different sufferers with different severities the treatments can be different for each person.

The Daily News says Dietl was confined to his bed for weeks after using the so-called "knap-sack heated rice footsie."

It was promoted on April 17, 2012.

Oz recommended filling a pair of socks with uncooked rice and warming them up in a microwave oven and putting them on.

The popular cardiothoracic surgeon said leaving them on for 20 minutes would promote better sleep.

He warned not to get the socks too hot.

"The Dr. Oz Show" said it couldn't comment until it could review the lawsuit.

Angelo and Hana Bisceglie are suing the celebrity TV heart surgeon because the Oz family planted trees next to their Cliffside Park property that they say are destroying their view of the Manhattan skyline.

Dr. Oz, his wife Lisa, and their children have lived at the mansion for close to a decade. So have their neighbors, the Bisceglies, who used to have the same magnificent, panoramic view of the Manhattan skyline – until the Oz family planted three 30-foot cedar trees on their property.

“They block the entire view of the downtown area, now we can’t see the Empire State Building,” Hana Bisceglie told CBS 2′s Magee Hickey. “Even from the bedroom window, we can’t see anything.”


The border war started as a skirmish two years ago, when the TV doctor placed bamboo trees and his pool and cabana construction site. The Bisceglies complained, saying they were flammable, so they were replaced with the view-blocking shrubs – and all because Lisa Oz is allegedly obsessed with her privacy.

“She doesn’t want to see paparazzi,” Hana said. “I don’t invite them here to my home.”

The Oz family’s construction manager, Mike Wujek, declined comment.

“Can’t say anything about the trees because of litigation,” Wujek said.

While no one inside the Oz home could speak to CBS 2, other neighbors could.

“He’s an asset, a fine neighbor,” Roberta Beehler said. “I have nothing bad to say about the man, only good things.”

To Hana Bisceglie, it’s all about being good neighbors, and she’s still hoping a compromise can be reached.

“It’s Cliffside Park, it’s not Alpine,” Hana said. “All the properties are close together. You should expect this.”

The neighbors claim the offending cedars have cost them more than $500,000 on the resale value of the $3 million dollar home

A lawyer for the borough of Cliffside Park said the lawsuit is just a conflict between the two neighbors over landscaping.

Dr. Oz’s lawyer did not return repeated requests for comment.

Cruise is just the latest A-list star attached to "The Man From U.N.C.L.E." The project was originally set up by Warner Bros. in November of 2010 with Steven Soderbergh set as director and George Clooney in the starring role. Clooney dropped out in August of that year after suffering a back injury, however, forcing Soderbergh to search for a replacement.

"I think in the end we talked about a lot of people. Matt [Damon] was busy; I think we considered a lot of different folk," screenwriter Scott Z. Burns, who wrote the "Man From U.N.C.L.E." script that Soderbergh was planning to direct, told Collider in January of this year. "It just didn't come together."

Johnny Depp, Channing Tatum, Bradley Cooper, Ryan Gosling and Michael Fassbender were also reportedly considered for the leading role, but no deals were closed. Soderbergh, meanwhile, eventually parted ways with "U.N.C.L.E." when he couldn't agree with Warner Bros. on the film's budget; he went on to direct this year's "Side Effects," which was written by Burns. Seven Marines were killed and eight wounded late Monday when a 60mm mortar round exploded during a training exercise at the Hawthorne Army Depot in Nevada, according to military and defense officials.

The Marines were part of the 2nd Marine Division, a ground combat force based at Camp Lejeune, N.C.

Renown Regional Medical Center in Reno, the area's major trauma hospital, took nine patients, including one who died, three who are in serious condition and five who are in fair condition, according to spokeswoman Stacy Kendall. All the patients are men under the age of 30, she said. Kendall described their injuries as penetrating trauma, fractures and vascular injuries.

A senior defense official said it appears that a mortar round exploded inside a firing tube instead of flying out. The official, speaking on background, cautioned that initial reports on the incident, which occurred around 10 p.m. Monday, could change on the cause.

The Marines immediately issued an indefinite moratorium on firing of all such mortars worldwide until an investigation clears as safe the type of weapon and ammunition in the tragedy.

The 60mm mortar is a weapon that traditionally requires three to four Marines to operate, but it's common during training for others to observe nearby.

The 230-square-mile desert facility, located about 140 miles southeast of Reno, stores conventional ammunition being taken out of use and, according to its website, also serves as "a premier training location for special forces."

"The unique aspects of mountainous terrain in a high desert environment provides a realistic simulation of the situation in Afghanistan," the website notes.

Army, Navy and Marine troops train year-round at the facility, which also provides training for foreign military nationals.

"We send our prayers and condolences to the families of Marines involved in this tragic incident. We remain focused on ensuring that they are supported through this difficult time," said Maj. Gen. Raymond C. Fox, commanding general of the 2nd Marine Expeditionary Force. "We mourn their loss, and it is with heavy hearts we remember their courage and sacrifice."

Hawthorne, Nev.

Nevada Gov. Brian Sandoval said in a statement that he was "deeply saddened" to hear of the incident at the depot.

"The men and women who work and train there put service ahead of self each and every day," Sandoval said. "Kathleen and I wish to extend our deepest sympathies to those killed and their families. Our thoughts and prayers are with those who have been injured and we pray for their speedy recovery."

The U.S. Joint Munitions Command says on its website that the depot is an "archive site" for storing slow-moving ammunition and stocks awaiting disposal.

The facility has more than 2,915 structures including igloos, supply warehouses, maintenance buildings, munitions sheds, and office buildings.
